Deltawing Technologies and Nissan are in a heated lawsuit and one company isn’t afraid to make it public.

Don Panoz and his Deltawing Technologies have been in a lawsuit since last December over alleged intellectual property violations on the Nissan Zeod RC. So far, Deltawing Technologies has designed two different ads attacking Nissan, publishing them both in The Tennessean and Automotive News. Both ads allude to how the Zeod RC is quite similar to the DeltaWing racecar and are open letters to Carlos Ghosn and the Japanese automaker.

According to a report from Autoblog, Deltawing Technologies decided to publish the ads after mediation between the two companies broke down earlier this year. Deltawing originally hopped to settle amicably but when a resolution couldn’t be had, the company decided to fight misconceptions with the general public about the program and lawsuit.

The same engineer, Ben Bowlby, designed both cars. “The work he did belongs to Panoz,” said Deltawing spokesperson Gary Fong. “It’s only his [Bowlby's] design if he patented it.”

The lawsuit is still unsettled and the case is currently in the discovery phase according to Fong.
